CBC Wins Lawsuit Vs. MLBAM
I would like to thank Greg for his efforts on this cause over the years also. What we have both believed true since we met in 1988 was finally decided today in a court of law.
On behalf of the industry and FSTA, lawyer Glenn Colton of Rotoworld.com also wrote a brief that was simply a masterpiece.

I think the news is great, but I guarantee, its not over by a long shot. Team Legacy - I would consider it nearly over. If the decision is based on uncontested facts submitted by both sides (which it sounds like it was), and she interpreted the law correctly, fantasy sports has a huge victory. The decision, I suspect, is likely to be appealed, but getting it reversed will be very difficult.
This decision will be cited in every other case brought against the fantasy industry.

From reading the 49 page document it appears CDM won every argument...plus some arguments it didn't even need to win ..but because they would have been considered if CDM lost previous arguments they would have been relevant at that point so the Judge stated what the rulings on them would be as well...and they were in CDMs favor. An appeal would have to over turn multiple layers of decisions. Very very long shot. It's over...just a matter of when MLBam admits it.

In a joint press release today from Major League Baseball Advanced Media and the MLB Players Association, the two entities said they would appeal the CBC vs. MLBAM decision. Here's the context of their release:
"We are disappointed by the Court's decision yesterday in CBC v. MLBPA and MLBAM. We expect to appeal the decision, and remain confident that we will prevail in that effort. We continue to believe that the use of the players, without their consent, to create this type of commercial venture is improper."

So we will appeal, lose again, and then say the same thing to try and save face."
